Respecting Terms of Service

Good day Everyone,

    There seems to be some speculation going around the web about how HeroEngine and the HeroCloud platform is set up and how it works. Some seem to think that development pre alpha servers and software are totally different from the alpha/beta or live servers and software.

    Though these two are deployed on two different servers, their configuration (or setup) is the same.  Live servers are using the same architecture and platform as our HeroCloud servers. The development and engineering team is the same, as the software is the same.

    However, there are a few differences between pre alpha HeroCloud and Live HeroCloud.
   
    First, where the world is hosted, covered above.
    Second, when you are ready to go to an open alpha or beta, we work with you while you pick how many servers you think you will need. Though we try to advise you towards the right number, so they will not cost us or you too much money, in the end, the choice is up to the game development team.  It is their game and their budget.
    Third, we continue to assist the teams with their development, and development issues, and assisted in creating new and custom features for the teams.
    Teams can (and have) gain access to their Master Control - this allows them to restart their server on their own, manually add or remove new players, etc.

    So, in the end, it is up to the game development teams to decide on the number of servers to fit their budget and expectations.

    We hope this helps to inform the community and those teams working hard on their games.

     IMPORTANT: We pay for all the base operating costs, but beyond the initial testing and launch window for your game if you wish to grow your game or keep your game at a distribution level beyond what our share of the revenue can cover, then you would either need to scale your game back, or cover the costs yourself. Basically, if you want to have 1 million players, but not charge them any money, then you are going to have to cover those costs, or work with us to figure out how to generate revenue from your player base.

    Please remember that when your game goes live, be it alpha, beta or release or you raise revenue through a crowd-funding campaign, you are always responsible for paying 30% of all revenue as royalties to us. If you refuse to pay our royalties within 30 days, we have the right to turn your servers off. However, first we will still attempt to work with you to:

    - Reduce the number of servers (merge servers)
    - Work out a payment plan or an alternative licensing model
    - And shut down servers only if no solution can be found.

    How does this relate to our current situation?

    Starting in September 2015, one of our clients has refused to pay our royalties amounting to 30% of their revenues. Idea Fabrik/IFS is a small company, and our funding relies on those royalties and our VC's.

    After two months of not getting our royalties paid, we were faced with difficult decisions. And after additional two months without being able to find a solution, we had to shut down their live game servers.

    Please note that we still hope for a positive outcome for all the players and fans of the game - that's why their development servers have always been and are still up and running, so they can continue to work on their game.
