I was finally able to get the mesh into the engine, I'm still not entirely sure what was causing the issue but exporting the mesh as an OBJ and then re-importing and re skinning it seems to have gotten rid of whatever junk data was hanging around.

The issue is what I listed in the previous post, you must triangulate your model, exporting as OBJ in Max with default settings triangulates your model. thus you reimported, it was triangulated, and skinned it, and it worked. we have had this issue many times with models from different artist.
